This website is operated by OutofBlue L.L.C-FZ (“OutofBlue,” “we,” “us,” or “our”). OutofBlue provides this website, including its content, products, services and purchasing features, to you subject to these Terms of Service.

These Terms apply to everyone who accesses the website or purchases from us, including visitors, customers and business purchasers.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and acknowledge our Privacy Policy, Shipping Policy, and Return, Exchange and Refund Policy.

If you do not agree to these Terms, you should not use the website or place an order.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer and sell our products.

  1. ELIGIBILITY AND CUSTOMER ACCOUNTS

You must be legally capable of entering into a binding agreement under the laws applicable to you.

If you allow a minor to use this website, you are responsible for supervising their use and for any orders they place with your permission.

You may browse and purchase from the website without creating a customer account where guest checkout is available.

If you create an account, you are responsible for:

We make reasonable efforts to present our products accurately, including their descriptions, colors, photographs, sizing and other characteristics.

However, the appearance of colors may vary depending on your device, display settings and lighting conditions. Minor differences in color, texture, stitching, measurements or packaging may occur within reasonable manufacturing tolerances.

Customers should review the applicable size guide before purchasing. Product measurements may vary slightly within normal manufacturing tolerances.

Product availability is not guaranteed. We may:

  • Change or discontinue products
  • Limit quantities available for purchase
  • Restrict sales to particular markets or locations
  • Correct product information
  • Refuse quantities that appear intended for unauthorized resale or misuse

Any material product restriction will be communicated where reasonably practicable.

  1. ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the selected products.

An automated order acknowledgment confirms that we received your order but does not necessarily mean that the order has been accepted. An order is accepted when we confirm fulfillment or dispatch, or otherwise expressly confirm acceptance.

All orders are subject to:

  • Delivery eligibility

We may decline or cancel an order before fulfillment when reasonably necessary, including when:

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method, subject to normal payment-provider processing times.

We may limit or cancel quantities purchased under the same account, payment method, billing details or delivery address where orders appear fraudulent, abusive or intended for unauthorized commercial resale.

  1. CUSTOMER INFORMATION

You agree to provide current, complete and accurate information when placing an order.

This includes:

  • Email address
  • Telephone number
  • Billing information
  • Complete delivery address
  • Any information reasonably required to process and deliver the order

You are responsible for reviewing your information before submitting an order.

If information needs to be corrected after an order has been placed, contact support@outofblueworld.com as soon as possible. We cannot guarantee that changes can be made once an order has entered processing or fulfillment.

Incorrect or incomplete information may result in delays, unsuccessful delivery attempts or additional delivery charges.

  1. PRICES, CURRENCIES AND TAXES

Product prices are displayed on the website and may vary by customer market, location or selected currency.

The display currency may differ depending on your location or website settings. The final purchase price, transaction currency, applicable taxes and delivery charges will be shown at checkout before payment.

Currency conversion may be performed by Shopify, the payment provider, the card issuer or another financial institution. Your bank or payment provider may apply its own conversion rate or additional fees. These third-party charges are outside our control.

Prices may change without notice. A price change will not affect an order that we have already accepted, except where correction is permitted by applicable law because of an obvious pricing error.

Applicable taxes, duties or similar charges will be applied where required and, when collected by us, will be shown at checkout.

For deliveries between markets or across borders, customers may be responsible for import duties, customs charges or government fees unless checkout expressly states that they are included.

  1. BILLING AND PAYMENT

Available payment methods are displayed during checkout and may vary by country, order value, currency or payment provider.

You confirm that:

  • You are authorized to use the selected payment method
  • The billing information you provide is accurate
  • Sufficient funds or credit are available
  • The payment does not violate applicable law

Payments may be processed by third-party payment providers. Their separate terms, fraud controls and privacy practices may apply.

We are not responsible for charges imposed independently by your bank, card issuer or payment provider, including currency-conversion, international-transaction or insufficient-funds fees.

If a payment is declined or reversed, we may suspend or cancel the affected order.

  1. SHIPPING AND DELIVERY

OutofBlue currently delivers within eligible areas of the United Arab Emirates and Jordan.

Available services, delivery charges and estimated delivery times are displayed at checkout according to the customer’s address and the inventory location fulfilling the order.

Delivery options may include same-day, next-day or standard delivery, depending on the destination, order time, inventory availability and operational capacity.

Delivery dates and times are estimates unless applicable law expressly provides otherwise. Delays may occur due to public holidays, weather, transportation disruption, delivery-provider delays, governmental restrictions or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and for ensuring that someone is available to receive the order when required.

Additional charges may apply where delivery fails because of an incorrect address, unavailable recipient or repeated unsuccessful attempts, to the extent permitted by applicable law.

  1. RETURNS, EXCHANGES AND REFUNDS

Eligible products may be exchanged under the conditions and within the period stated in our Return, Exchange and Refund Policy.

We do not generally provide refunds for change of mind, incorrect size selection or color preference. Eligible size or color changes may be processed as exchanges.

Different remedies apply when an item is defective, damaged or different from the item ordered.

Returns and exchanges must be approved before items are sent. Products delivered in Jordan cannot be exchanged through the UAE, and products delivered in the UAE cannot be exchanged through Jordan.

Nothing in these Terms or our policies excludes or limits any mandatory remedy or consumer right that cannot legally be excluded.

  1. PROMOTIONS AND DISCOUNTS

We may offer discounts, promotional codes or special offers from time to time.

Unless otherwise stated:

  • Promotions are available for a limited period
  • Promotions cannot be combined
  • Promotional codes have no cash value
  • Promotions may be limited by customer, product, market or order
  • Discounts cannot be applied after an order has been completed
  • Returns or exchanges may affect the value of a promotion

We may amend or withdraw a promotion where reasonably necessary, but this will not affect an order already accepted unless required to correct fraud, abuse or an obvious error.

You may use this website only for lawful purposes.

No provision in these Terms transfers ownership of our intellectual property to you.

OutofBlue’s store is hosted by Shopify. Shopify provides the ecommerce platform through which we offer our products.

Purchases made through this website are transactions between the customer and OutofBlue. Shopify is not the seller of our products and is not responsible for fulfilling orders, handling product complaints or providing remedies relating to our products, except where Shopify separately provides a service directly to you.

To the extent permitted by law, you agree that Shopify and its affiliates are not responsible for claims arising solely from transactions between you and OutofBlue.

  1. PRIVACY

Personal information collected through the website is handled according to our Privacy Policy:

  • Unauthorized use of a customer’s account or payment method where we were not at fault
  • Third-party systems outside our reasonable control
  • Events outside our reasonable control

Where liability can lawfully be limited, our total liability arising from a particular order will not exceed the amount paid for that order.

This limitation does not reduce any remedy that must be provided under applicable consumer-protection law.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to compensate OutofBlue for reasonable losses, liabilities and expenses directly resulting from your intentional unlawful use of the website, infringement of another person’s rights or material violation of these Terms.

This provision does not apply to losses caused by OutofBlue or where enforcement would limit mandatory consumer rights.

  1. SUSPENSION AND TERMINATION

You may stop using the website at any time.

We may suspend or terminate access to the website or a customer account where reasonably necessary because of:

  • Security risks
  • Illegal activity

These Terms, together with the policies referenced in them and any order-specific conditions shown at checkout, constitute the agreement between you and OutofBlue concerning your use of the website and purchases made through it.

If an order-specific condition conflicts with these general Terms, the order-specific condition will apply to that order to the extent permitted by law.

  1. ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our consent.

We may transfer our rights or obligations as part of a business reorganization, merger, sale or transfer of operations, provided this does not reduce your mandatory rights.

  1. GOVERNING LAW AND DISPUTES

These Terms and transactions with OutofBlue are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.

The courts of Dubai will have jurisdiction over disputes, subject to any mandatory consumer-protection rights or jurisdictional rules that apply in the customer’s country or market.

Before beginning formal proceedings, customers are encouraged to contact support@outofblueworld.com so that we can attempt to resolve the matter.

Nothing in this section prevents a customer from using a mandatory complaint or dispute-resolution procedure available under applicable law.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, services, legal obligations or website functionality.

The current version will be published on this page with its latest update date.

Changes apply from publication and do not retrospectively reduce rights connected to an order already accepted, except where required by law.

Continued use of the website after an update means that the updated Terms apply to future use and future orders.
